April 2, 2019 - April 30, 2019
A growing list of states has approved the use of medical marijuana and now for recreational use as well. Governor Cuomo has stated that full legalization of marijuana in New York State is a priority for 2019. As of this writing, the Legislature is debating the terms for legalization. These developments raise complex issues for employers. In this Breakfast Briefing, we will address the workplace issues raised by legalization, including:
- How do employers reconcile conflicting state and federal law requirements?
- What is the impact on employee drug testing programs and employee conduct policies?
- How will marijuana usage be treated under the NY Labor Law?
- What reasonable accommodation obligations exist for certified medical marijuana users?
