Reviewing Legal Issues with Vaccination Incentive Programs

As a bonus to Bond’s May 11 webinar about the evolving legal implications of COVID-19 for business, Bond employee benefits attorney Daniel J. Nugent recorded a short video about issues related to employer-incentivized COVID-19 vaccination programs.
Such programs generally are considered wellness programs and, therefore, subject to a variety of laws, including the Americans with Disabilities Act (ADA), the Genetic Information Nondiscrimination Act (GINA) and the Health Insurance Portability and Accountability Act (HIPAA), and their associated incentive limits, reasonable accommodation requirements and more. Bond expects the Equal Employment Opportunity Commission to release guidance soon that will clarify how employers can structure vaccination incentive programs without conflicting with the requirements and restrictions of the ADA, GINA and HIPAA.
