Even though the Northern District of Texas invalidated the Federal Trade Commission’s rule that would have voided most non-compete agreements, it isn’t back to business as usual. New York narrowly avoided a total non-compete ban late last year due only to Governor Hochul’s veto—but she also stated she would support a non-compete ban for “middle-class and low-wage earners,” not to mention that New York courts regularly invalidate non-compete agreements, even without a legislative ban.
