Implications of Supreme Court Taking Up Reverse Discrimination Case

As a follow-up to this week’s Business in 2024 webinar, Bond labor and employment attorney Kelly L. McKinney recorded a brief summary of the U.S. Supreme Court’s recent decision to hear Ames v. Ohio Department of Youth Services, a case that could set a new standard for reverse discrimination claims by eliminating the so-called “background circumstances” requirement. If the Court rules in favor of the plaintiff – a heterosexual woman who was demoted and then replaced by a gay man – an increase in reverse discrimination complaints could follow.
