Implications in Discrimination Claims

In this week’s Business in 2024 webinar, Bond labor and employment attorney Peter H. Wiltenburg discussed the implications of Bart v. Golub Corp., an important decision clarifying the legal standard in federal antidiscrimination claims. In this case, which was a gender discrimination claim, the Second Circuit clarified the legal standard to apply in “mixed motive cases” where there are both a legitimate nondiscriminatory reason and a discriminatory reason that is a motivating factor for the termination, the employer can still be liable under a Title XII claim in that situation.
