Navigating Potentially Overlapping Leave Laws
The COVID-19 pandemic has presented unique and unprecedented challenges for businesses everywhere, especially here in New York State. Federal, state and local governments have responded to the COVID-19 pandemic by enacting laws and providing guidance, while businesses have attempted to adapt to rapidly changing conditions. These new COVID-19 specific laws contain important provisions related to employee leave, including when paid and/or unpaid leave is available and under what circumstances leave is required. In this time of remote schooling, travel restrictions, and quarantine requirements, employers must consider leave requests in the context of these new COVID-19 laws, but must also understand how these new laws work together with existing leave laws and their own existing leave policies. With evolving guidelines and policies aimed at maintaining the health of both employees and companies, employers are asking themselves the daunting question, “What should we do?”
This virtual Breakfast Briefing is intended to help employers understand their obligations in responding to leave requests. We will cover the new leave obligations imposed by the federal and state COVID-19 laws, including:
- Federal Expanded Family Medical Leave Act (EFMLA)
- Federal Emergency Paid Sick Leave (EPSL)
- New York COVID-19 Paid Sick Leave
We will also discuss how preexisting leave laws impact employer leave obligations, such as:
- Family Medical Leave Act
- American with Disabilities Act (ADA)
- Paid Family Leave (PFL)
Finally, we will cover how existing leave policies may need to be adjusted in light of these new obligations.
