In a landmark decision, the U.S. Supreme Court in Janus struck a harsh blow against public sector Unions when they stripped away the unions’ ability to collect agency fees from nonunion workers without their affirmative consent. The Court concluded that requiring the payment of agency fees that cover the costs associated with collective bargaining violated the employees’ first amendment rights against compelled speech. The impact of Janus on public employers, employees and unions will be discussed, along with an overview of the recent Taylor Law amendments and the practical approaches both employers and unions are utilizing to deal with the changing landscape resulting from Janus.
